Terms of Service
These Terms of Service ("Terms") govern your use of ReSpring ("the App"), a task management app for iOS operated by ReSpring LLC ("ReSpring," "we," "us," or "our"). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
Your use of the App is also subject to Apple's Licensed Application End User License Agreement, which is incorporated by reference. Our handling of your data is described separately in our Privacy Policy.
1. The App
ReSpring is an iOS task manager designed for ADHD and neurodivergent minds. Features include:
- AI-assisted task creation and organization (processed on your device)
- Automatic task redistribution across upcoming weeks (ReBalance)
- Calendar-aware scheduling and conflict deconfliction (optional, on-device)
- A garden-based gamification system for task completion
We may modify, suspend, or discontinue features at any time.
2. Eligibility
You must be at least 13 years old to use ReSpring, or the higher minimum age required by your jurisdiction (for example, 16 in parts of the EU/EEA). If you are using the App on behalf of a minor under your guardianship, you accept these Terms on their behalf.
3. Your Data
Your task data is stored on your device and synced through your personal iCloud account using Apple's CloudKit. ReSpring does not operate servers that store your task data and cannot access it. Data loss caused by changes to your Apple ID, iCloud storage limits, or Apple service outages is outside our control.
AI features in the App run on your device. If you choose to opt in to share anonymous AI improvement data, the handling of that data is described in our Privacy Policy.
You are responsible for the security of your Apple ID. If you believe your account has been compromised, contact [email protected].
4. Subscriptions and Billing
ReSpring is currently provided free of charge. When paid subscription plans (ReSpring Bloom) become available, all billing will be processed by Apple through the App Store, and these Terms will be updated to describe the available plans, free trial terms, auto-renewal, cancellation, and refund handling. Existing users will be notified of those changes within the App before paid plans take effect.
5. AI Features
ReSpring uses AI to assist with task creation, suggestions, and organization. As described in our Privacy Policy, AI processing happens on your device — either through Apple's on-device FoundationModels or a deterministic on-device rules engine. Your input is not sent to ReSpring or any third party for AI generation.
You acknowledge that:
- AI-generated suggestions may be inaccurate, incomplete, or unsuitable for your specific situation.
- You are responsible for reviewing, accepting, or rejecting any AI-generated content before acting on it.
- We make no warranty that AI features will meet your productivity or scheduling needs.
AI features are assistive tools only. Do not rely on them for medical, legal, financial, or other high-stakes decisions.
6. Intellectual Property
The App, including its design, code, graphics, and associated content (excluding your personal task data), is owned by ReSpring and protected by intellectual property laws. Nothing in these Terms grants you ownership of any ReSpring intellectual property.
Your task data belongs to you. To the extent you choose to share data with us — for example, opt-in AI improvement data described in our Privacy Policy — you grant us a limited, non-exclusive license to process that data solely for the stated purpose.
7. Prohibited Use
You agree not to:
- Reverse engineer, decompile, or attempt to extract the App's source code, except to the extent such restrictions are prohibited by applicable law.
- Use the App for any unlawful purpose or in violation of applicable regulations.
- Automate access to the App or its backend in ways not intended by normal use.
- Redistribute or resell the App or any of its components.
8. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
9. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, RESPRING SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP, INCLUDING LOSS OF DATA, MISSED TASKS, OR LOST PRODUCTIVITY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID FOR YOUR CURRENT SUBSCRIPTION PERIOD, OR $10.00 USD IF NO PAYMENT WAS MADE.
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot be limited or excluded under applicable law.
10. Apple-Specific Terms
These Terms are between you and ReSpring only, not with Apple Inc. Apple is not responsible for the App or its content. To the maximum extent permitted by applicable law, Apple has no warranty obligation whatsoever with respect to the App. Any claims relating to the App's failure to conform to any applicable warranty may be directed to Apple, and Apple will refund the purchase price (if any). Apple is not responsible for addressing claims relating to the App or your possession or use of it, including product liability claims, claims that the App fails to conform to legal or regulatory requirements, or claims arising under consumer protection or similar legislation. Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple has the right (and is deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
11. Governing Law
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict of law provisions, and without prejudice to mandatory consumer protections in your jurisdiction of residence. Any disputes shall be resolved in the courts of Virginia, and you consent to personal jurisdiction in that venue.
12. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the effective date above and notify you within the App for material changes. Continued use of the App after changes are posted constitutes your acceptance of the revised Terms.
